Court Orders Laywer to Personally Pay Costs Associated with Biased Expert Witness - Lonny Rosen Comments

In a recent decision of the Superior Court of Justice, a lawyer was ordered to personally pay approximately 20% of the costs awarded to the successful party. The court made this rare order due to a determination that an expert witness called to give evidence in the case was biased, and that the lawyer who proffered the expert wtiness had to have been aware that the expert was too personally involved in the case to discharge his duty to the court.
